La Ley 820 del 2003, se crea con el objetivo de definir criterios que puedan servir como pilar para regular los contratos de alquiler de los inmuebles urbanos usados como vivienda. Estableciendo por medio está, algunos parámetros estandarizados y que contribuyan a la propiedad con función social.
En esta ley se define el contrato de alquiler de vivienda urbana, en este se estipula que las dos partes se obligan recíprocamente. Por parte del arrendador, a conceder el goce de la propiedad urbana destinado a vivienda, de forma total o parcial. Y por parte del arrendatario, a pagar una cantidad estimada por el goce del inmueble y sus servicios.

¿Qué debe contener un contrato de arrendamiento de inmueble para vivienda?
Según la Ley 820 del 2003, es reconocido legalmente un contrato de arrendamiento para vivienda urbana, de forma verbal o escrita. Sin importar su forma de contratación, dicho contrato debe ser fiel a los siguientes parámetros estipulados por el gobierno.
- Para iniciar, el contrato debe incluir de forma clara y sin enmendaduras el Nombre y la identificación de los interesados en el contrato.
- Definir la naturaleza del contrato para el cual se alquilará el inmueble en caso de ser para vivienda, dejar claro las reglas de uso y cuidado.
- Para el caso del arriendo de un inmueble por partes o zonas, se debe ser bastante específico con los accesos y las zonas comunes que se pueden usar.
- Recuerda siempre definir el precio del alquiler del inmueble, además de estipular la forma de pago.
- Si se divide el pago de algún servicio, también se debe dejar definido de qué forma será el pago.
- Dejar claro en el contrato la duración del alquiler es fundamental, asimismo, definir bajo qué circunstancias se puede cancelar dicho contrato.
¿Garantías y depósitos?
En el Artículo 16, de la Ley 280 del 2003, se habla de la prohibición de depósitos y cauciones reales. Para el caso de los contratos de arriendo para vivienda, no pueden exigir depósitos de dinero efectivo o en otras presentaciones. Esto para garantizar que se cumpla con las obligaciones estipuladas en dichos contratos.
Dichas garantías no podrán estipularse indirectamente ni de forma extra, o por fuera de contratos, todo debe quedar claro y directo. Los ajustes o arreglos extra, pueden ser motivo de inconformidades más adelante.
¿Qué pasa con los subarriendos o arriendo a terceros?
Dentro del Artículo 17 de la Ley 280 del 2003, también se define lo correspondiente a Subarriendo y cesión de contrato. Quien toma en arriendo no cuenta con el derecho de ceder el contrato ni subarrendar en el inmueble, siendo una situación diferente, si se considera por ambas partes del contrato.
Para el caso de contravención, el dueño del inmueble, podrá dar por terminado el contrato de arrendamiento al finalizar este mismo. Además, de solicitar con un tiempo prudente el inmueble e informar la finalización del contrato. Se estipula, también, que se debe hacer previa notificación por escrito.
Estos son algunos de los puntos más relevantes de La Ley 280 del 2003, dentro de la cual se estipula y define lo que debe contener un contrato de arrendamiento. Además, define algunos de los requisitos indispensables en la generación de contratos de arrendamiento de inmuebles para vivienda.
